Wow long. Look, I'm just trying to demonstrate, with examples, labor laws. Trying to point out that one can not sign a contract that abridges a law. And finally trying to point out that the way to avoid a lawsuit is to err on the side caution when dealing with employees and never stiff them for a second of their time, because the Gamestop example is exactly what happens when you do.

Why MUST I not work for more than 10 hours in a sawmill (in my state) even if my employer makes me sign something saying I will work for 12 hours? Because labor law says I can't, and furthermore can not sign a document as an employee that abridges that labor law. I dont have that power and neither does my employer. Otherwise people would be signing up to drink bleach or eat asbestos.

A contract that has as its purpose an illegal end is not a valid contract and is null.

You haven't been a manager, I assume.
You can not compel an EMPLOYEE to sign a document that abridges their rights as an employed person, no matter what. Contractors are a much different story.
I can't sign away my right to be compensated for overtime as an hourly employee, if I could wouldn't every hourly employer make me sign a piece of paper saying I relinquish my right to OT compensation?

The company and the manager are the same thing, the manager is the agent of the company, they are the primary interface between employee and employer and the direct responsibility of the company.

You can not sign away your wage and hour rights no more than you can sign away your health and safety rights. It is asking for this type of lawsuit to attempt to compel an employee to do anything while you are not compensating them. If your policy is so important, just pay your employee for that extra 4 seconds or whatever.
