"Well, I'm not a lawyer, but I'd bet the OP has more than satisified his legal obligation to opt out of binding arbitration, should such an event occur that requires him to sue Discover.
It would however be fun to see him sue Discover for failing to process his request and then have them try to force him to go to arbitration.
